ISUZU UTE ROAD TO THE FINAL - ULTIMATE A-LEAGUE GRAND FINAL EXPERIENCE COMPETITION

The Isuzu UTE Road to the Final Ultimate A-League Grand Final Experience (“the Competition”) enables eligible residents of Australia (aged 18+) only to enter a game of chance, with the aim of winning a travel package for themselves and a friend to attend the 2024 Men’s A-League Grand Final between Friday 24th May and Sunday 26th May 2024 (location still to be determined) (“Final”).

The promoter is Isuzu UTE Australia Pty Ltd ABN 80 129 563 739 (“Promoter”) of 1000 Wynnum Road, Cannon Hill QLD 4170 (“Promoter’s Premises”), Phone: 07 3151 5888.

TERMS AND CONDITIONS

Acceptance of Terms and Conditions

These terms and conditions (“Terms”) apply to the Competition. Submission of an entry to the Competition via an online entry form, accessible at www.isuzuute.com.au/roadtofinal is deemed acceptance of these Terms (“Entry”).

Competition Period

The Competition commences at 9:30am AEST on 15/03/2024 and closes at 11:59pm AEST on 29/04/24 (“Competition Period”).

Eligibility

Participation in the Competition is open to individuals who are:

  • permanent residents of Australia;
  • aged 18 years or older;
  • have legal capacity to enter and participate; and
  • willing and able to travel to the 2024 Men’s A-League Grand Final host city between the dates of 24/05/24 – 26/05/24 (“Entrant”). Possible Final location to be determined, possible locations are:
    • Sydney;
    • Melbourne;
    • Brisbane;
    • Perth;
    • Adelaide;
    • Wellington (New Zealand);
    • Central Coast – Gosford; and
    • Newcastle).

Directors, management and personnel of the Promoter, authorised Isuzu UTE dealerships, and their immediate families or their related companies or any of their agencies, partners or service providers associated with the Competition, are not eligible to enter the Competition.

Multiple entries are permitted to the Competition; however, each Entry must be submitted separately and in accordance with these Terms and Conditions.

The Promoter reserves the right, at any time, to verify the validity and eligibility of an Entry and Entrants (including an Entrant’s identity, age, and place of residence) and to disqualify any Entrant whose Entry is not in accordance with these Terms, engages in unlawful or improper conduct, acts in a disruptive manner, acts with the intent to annoy, abuse, threaten or harass another person or who otherwise tampers with the Entry process. The Promoter reserves the right to recover damages or other compensation for such an offender. The Promotor’s decision on eligibility is final and no correspondence will be entered into during and/or after the Competition Period. Entrants must not enter via use of automatically generated entries or use multiple phone numbers/email addresses/addresses/aliases, otherwise Entrants may be disqualified.

How To Enter

Entry to the Competition is via an online Entry form accessible at www.roadtothefinal.isuzuute.com.au by playing the Isuzu UTE A-League Road to the Final Game and fully completing their details in the Entry form as required.

An incomplete or indecipherable Entry will be deemed invalid. The Promoter accepts no responsibility for any incorrect, incomplete, late, lost or misdirected Entry, including Entries not received by the Promoter or delays in the delivery of an Entry due to technical issues.

By agreeing to enter the Competition, the Entrant is agreeing to give the Promoter access to the Entrant’s personal information in the form of their full name, their email address and their phone number, to subscribe to the Promoter, for marketing and related purposes.

The Entrant can stop, opt out or unsubscribe from the Promoter's marketing messages, and this is at no cost to the Entrant. If the Entrant clicks on the unsubscribe link in any of the Promoter’s written communications such as emails or SMS messages, or contacts the Promoter via its contact form or other channels, see the Privacy Policy at: https://www.isuzuute.com.au/privacy-policy for these contacts, the Promoter will take all reasonable steps to stop sending the Entrant its marketing material within 5 business days of the Entrant’s request to unsubscribe.

Personal Information & Privacy

The Promoter is bound by the Privacy Act 1988 (Cth), including but not limited to the Australian Privacy Principles, and any other applicable Australian laws. The Promoter will collect the Entrants’ personal information, including the Entrant’s full name, nominated email address, phone number and postcode of the Entrant’s residential address, at the time of entry into the Competition.

The Promoter collects personal information about Entrants to enable them to participate in the Competition and may disclose the Entrants’ personal information to agencies, partners, or service providers to assist in conducting the Competition including for the purposes of communicating with Entrants and/or Winners.

If the Entrant does not provide their personal information, the Entrant may be ineligible to enter the Competition and if the Entrant wins the Competition, the Entrant may not be eligible to claim the Prize.

The Promoter will deal with personal information in accordance with its competition Collection Statement and privacy policy at www.isuzuute.com.au/privacy-policy ("Privacy Policy”). The Promoter’s Privacy Policy and Collection Statement notifies the Entrant of the collection, use and disclosure of, and access to the Entrant’s Personal Information and how the Entrant may update and seek correction of the personal information the Promoter holds about the Entrant. Further, the Collection Statement notifies the Entrant of how they may complain about any potential breach by the Promoter of the Privacy Act 1988 (Cth).

Winners

The draw will be conducted at 12pm (AEST) on 08/05/2024 at Gadens Lawyers, Level 13, 447 Collins Street, Melbourne VIC 3000. The first two (2) drawn valid Entrants will be deemed the winning entries (“Winner”).

There will be two (2) Winners who will be randomly drawn from a pool of valid Entrants which have entered the Competition during the Competition Period. The Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entrant is deemed invalid or a prize is unclaimed (Reserve Entrants). Skill plays no part in determining a Winner.

The Winners will be notified via email and by telephone within two business days of the prize draw.  The Winners names will be published on 09/05/24 at www.isuzuute.com.au/roadtofinal for a period of no less than 28 days.  Given that the prize is event based, Winners have until 12pm (AEST) on 17/05/24 to claim the prize and confirm their availability (including the availability of their selected companion).

For the avoidance of doubt, a companion may not be required to be 18 years of age to attend the trip. However, depending on the location of the game, the companion may need to be 18+ years of age to attend the corporate suite. This will be confirmed with the Winner when they are notified.

The Winner and their companion are solely responsible for ensuring that they both hold a valid passport and are able to travel to Wellington, New Zealand (should the Grand Final take place there.)

Should any prize remain unclaimed, by 12pm (AEST) on 17/05/24, the Promoter will conduct an unclaimed prize draw from all non-winning valid entries on 17/05/24 at 2pm (AEST) at Gadens Lawyers, Level 13, 447 Collins Street, Melbourne VIC 3000. Any winner in this unclaimed prize draw will be contacted by telephone and email immediately and will have 24 hours to claim the prize. If the prize remains unclaimed thereafter, the Promoter will continue selecting a Winner at random, until the prize has been claimed and awarded.

The Winners of the Competition give the Promoter permission to use the Winner’s full name and location (state, territory, town, or city) on the Promoter’s Facebook page and/or Competition website (www.isuzuute.com.au/roadtofinal) for the Winners announcement and promotional purposes, after the prize is claimed.

The Promoter’s decision is final, and no correspondence or communication will be entered into in relation to the selection of the Winners or any other aspect of the Competition.

The offer of a prize to a Winner is conditional upon the Winner accepting any terms and conditions imposed on the Winner, including but not limited to conditions of entry into the stadium at the Final.

The Prize

There are 2 prizes available, each valued at $5,000 AUD including GST. The total value of all prizes is at $10,000 AUD, including GST. Each prize package includes the below for each Winner (“the Prize”):

• 1x Flight Centre gift voucher valued $4,500, AUD including GST. Can be used for the Winner to organise and book:
      ◦ return flights from their nearest capital city airport to the city where the 2024 Men’s A-League Grand Final will be hosted (including airfare taxes and transfers if required); and
      ◦ accommodation for the winner and their companion at any available hotel in the city where the 2024 A-Leagues Men Grand Final will be hosted.
• 2 x Corporate Suite tickets at the 2024 Men’s A-League Grand Final, including food and beverages, valued at a total of $500 AUD including GST.

For the avoidance of doubt, the Promoter will not be involved in arranging the flights/accommodation, and any additional flight and accommodation costs above $4,500 AUD (including GST) will be the Winner’s sole responsibility. If the flight and accommodation costs are less than $4,500 AUD including GST, the remaining amount of the Flight Centre Voucher awarded to the Winner will become the property of the Winner. If a Winner resides in the city where the 2024 Men’s A-League Grand Final will be hosted, and hotel and flights are not required, they will still be awarded the 1x $4,500 Flight Centre voucher.

The Prizes do not include any airport transfers, transfers to and from the Final from the accommodation or additional expenses incurred.

The Prize is not transferable or redeemable for cash.

The Flight Centre gift voucher will expire 12 months after the date of issue and is to be used in accordance with the terms and conditions available at (https://www.flightcentre.com.au/gift-card-terms-and-conditions). The Flight Centre gift voucher will be sent via Registered Australia Post within three business days of the Winner claiming the Prize.

The Prize is non-transferable, non-refundable, cannot be sold or exchanged for cash and cannot be used in conjunction with any other offer.

General

If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify Entries; or (b) to modify, extend, suspend, terminate or cancel the Competition without prior notice, as appropriate subject to any necessary approval by the state/territory gaming regulators.

The Competition is not available in conjunction with any other promotion and/or offer.

The Promoter’s decision in relation to any aspect of the Competition is final and binding for every Entrant. No correspondence will be entered into with the Promotor.

The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted, or misdirected Entries, whether due to error, omission, alteration, deletion, theft, destruction, transmissions interruption, communications failure or otherwise. The Promoter has no control over communications networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. In the event that an error with an Entry occurs, the Promoter accepts no responsibility for costs incurred, responses received or any other consequences. Entrants must notify the Promoter if their contact details change.

The Promoter accepts no responsibility if the Final is abandoned, called off or postponed for any reason. In that case the Winner and their companion forfeit their entitlement to that element of the prize.

The Winner of a Prize must notify the Promoter if their contact details change during the Competition Period.

The Promoter may require the Winner and their companion to verify their identity and compliance with specified eligibility requirements at any time prior to being able to claim the Prize. The Promoter reserves the right to request the Winner and their companion to provide proof of identity and Australian residency. Identification considered suitable for verification is at the sole discretion of the Promoter.

If any aspect of this Competition is considered in the reasonable opinion of the Promoter to no longer be practical or desirable to run as planned for any reason, is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures, government directives, a pandemic, public health orders and the like, legally binding directive to the Promoter to end any component of the Competition or any causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify, extend or suspend the Competition, subject to any necessary directions of any relevant authority. In taking such action the Promoter may deem that the Competition closed on a date different to that provided for in these Terms, including a date that has already occurred.

The Promoter reserves the right, in its sole discretion, to disqualify entry from any person, and prohibit that person's further participation in this Competition, who in the reasonable opinion of the Promoter tampers with, or benefits from any tampering with, the process or the operation of the Competition, acts in violation of these Terms, acts in a disruptive manner, engages in unlawful or other improper conduct, or acts with the intent to annoy, abuse, threaten or harass any other person. The Promoter’s rights to recover damages or other compensation from such an offender are reserved.

The Promoter, any of its agencies, partners or service providers accept no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. Where the operation of the Competition results in, for GST purposes, supplies being made for non-monetary consideration, Entrants agree to follow the Australian Taxation Office’s requirements.  All Entries will be the property of the Promoter.

This competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter. Entrants provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
